Terms of Service

1. Agreement and eligibility

By downloading, creating an account, purchasing a subscription, or using kcalamari, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.

You must be legally able to enter this agreement. The app is not directed to children, and progress-media features require you to be at least 18 years old.

2. The service

kcalamari helps you log food, estimate nutrition, set goals, record weight, and follow progress. Some features use Apple Health, camera or photo access, iCloud, Open Food Facts, or AI services only when you choose to use them and grant the relevant permission.

Features, supported devices, limits, and availability may change. We may suspend a feature to maintain security, comply with law, or protect the service and its users.

3. Account and security

Sign in with Apple is used to create and access your account. You are responsible for maintaining control of your Apple account and device, and for activity carried out through your kcalamari account. Tell us promptly at phil@adler.studio if you believe the account has been compromised.

You may sign out or permanently delete your account in Settings → Account. Account deletion is irreversible and may not remove data separately held on your device, in your private iCloud, by Apple for purchases, or where legal retention is required.

4. Subscriptions and payments

Paid plans are offered as in-app purchases through Apple. The price, billing period, trial terms, and included usage shown in the App Store or purchase sheet apply to your purchase. Payment is charged to your Apple ID. Subscriptions renew automatically unless canceled through Apple at least 24 hours before the current period ends.

You can manage or cancel subscriptions in your Apple account settings. Refunds are handled by Apple under its policies and applicable law. Deleting your kcalamari account does not by itself cancel an Apple subscription.

5. AI and nutrition information

Nutrition values, AI outputs, barcode data, and goal calculations are estimates and may be incomplete or wrong. You are responsible for reviewing entries before relying on them. Do not use kcalamari to diagnose, treat, or prevent any condition.

kcalamari is not a medical device and does not provide medical, dietary, or emergency advice. Consult a qualified professional for decisions involving allergies, eating disorders, pregnancy, medication, chronic conditions, or other health concerns. In an emergency, contact local emergency services.

Bring Your Own Key requests are made under your own OpenAI account. You are responsible for that account, its charges, and compliance with OpenAI's terms.

6. Your content and community submissions

You retain ownership of text, photos, and other content you submit. You grant us a limited, non-exclusive right to host, process, transmit, and display that content only as needed to provide, secure, and support the service.

If you submit product or barcode information to the community database, you confirm that the submission is accurate to the best of your knowledge and that you have the right to provide it. You grant us a worldwide, royalty-free, perpetual license to use, verify, correct, and distribute the submitted factual product information. Review photos are used as evidence and deleted after approval or rejection.

7. Acceptable use

You must not:

• Break the law or infringe another person's rights.
• Upload malware, abusive content, or content you are not entitled to use.
• Attempt to bypass security, usage limits, subscriptions, or access controls.
• Scrape, reverse engineer, disrupt, overload, or misuse the service, except where applicable law expressly permits it.
• Use AI features to process content unrelated to their intended nutrition and progress-tracking purpose.

8. Intellectual property

The app, website, branding, software, and original content are owned by adlerlagune OG or its licensors. These terms give you a personal, limited, revocable, non-transferable license to use the app for its intended purpose. Open-source components and third-party data remain subject to their respective licenses.

9. Availability, warranties, and liability

We provide the service with reasonable care. To the extent permitted by law, it is otherwise provided “as is” and “as available,” without a promise that it will always be uninterrupted, error-free, or meet every individual goal.

We are liable without limitation where liability cannot lawfully be excluded, including for intent, gross negligence, injury to life, body or health, and mandatory consumer rights. Otherwise, our liability is limited to foreseeable damage caused by a material breach of an essential obligation. Nothing in these terms limits rights you have under mandatory consumer law.

10. Suspension and termination

You may stop using kcalamari at any time. We may restrict or terminate access if you materially breach these terms, create security or legal risk, or misuse the service. Where reasonable, we will give notice and an opportunity to remedy the issue.

11. Apple terms

These terms are between you and adlerlagune OG, not Apple. Apple is not responsible for the app or its support. Your use of the app must comply with the App Store rules and Apple Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the provisions that relate to them.

12. Governing law and changes

Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory protections and courts available in your country remain unaffected.

We may update these terms for legal, security, or product changes. Material changes will be communicated in the app or on this page. Continued use after the change takes effect means you accept the updated terms where permitted by law.
